I have had one of these for over a year. The cap has never popped off when pulling it from the Treo. The ink has lasted a year under occasional use. It finally ran out so I'm buying again.Now if they could put a small pad of paper in with the pen.....
Not Bad - SOme Modifcations
If you force the cap on tightly by tapping with some force on your desk is should stay secure for a while...
After realizing I didnt REALLY NEED the pen I superglued the cap to make sure it wouldnt ever come off.
So JAM ON it or GLUE it and then you have a fine replacement escpecially since originals are no longer available.
I am keeping mine.

did they try it out at the factory?
To make this work right they should have made the cap a screw on cap, just like some palm styli have screw on caps over their reset instrument. The thumb-catch should not just pop off and leave the stylus stuck in the phone where its no good for anything1

This pen has a pop off cap. That means that when you stick the stylus in the treo and then decide to use the stylus, and hook your fingernail around the top of the stylus to pry it out, surprise, the top pops off and you are looking at the business end of a pen. I tried my new pen/stylus for size and I didn't know if I was ever going to get it out of the pen w/o buying some extremely sharp needle nosed pliers. Luckily I was able to pry it out with a pointy knife. Once it was out I tried the pen. 2/3 of the pens in my three pack worked but the ink was sort of light.To make this work right they should have made the cap a screw on cap, just like some palm styli have screw on caps over their reset instrument.
